A misdemeanor, presided over in County Court, is a lesser offense than a felony. Unfortunately, a misdemeanor can still result in many unfavorable consequences if convicted, specifically a criminal record, loss of and difficulty obtaining gainful employment, loss of personal freedom and a compromised reputation. First degree misdemeanors are punishable by up to a year in jail, one year of probation and $100 fine while second degree misdemeanors are punishable by up to sixty days in jail and a $500 fine. Some offenses may be charged as felonies depending on the particular fact pattern and aggravating circumstances such as property damage, injury to another’s person and multiple misdemeanors. Similarly, tampering with evidence and fleeing or eluding a law enforcement officer are serious felonies which are punishable by lengthy state prison.
